Welcome to Motherhands ("Platform", "we", "us", or "our"). Motherhands operates as a Multi-Restaurant QR Code Scanning, Digital Menu, and Online Ordering SaaS (Software as a Service) platform. By creating an account, subscribing to our services, or utilizing our platform for ordering, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms and Conditions. These terms establish a binding legal agreement between Motherhands, the participating restaurants/vendors ("Merchants"), and the customers placing orders ("End Users").

2. Merchant Onboarding and Obligations

A. Account Registration and Verification

Merchants must provide legitimate business credentials, accurate operational addresses, banking details for financial settlements, and valid regulatory licenses (such as FSSAI, GST, or local municipal trade licenses) during registration. Merchants are exclusively responsible for preserving the confidentiality of their dashboard credentials and for all activities occurring under their sub-domain or account.

B. Menu Management, Accuracy, and Compliance

Merchants possess complete administrative control over their digital menus. The Merchant is solely responsible for ensuring that item names, dietary descriptions (e.g., Veg/Non-Veg classifications, allergen warnings), ingredient details, item images, taxes, and prices are entirely accurate. Motherhands completely disclaims any liability for financial discrepancies, customer disputes, or transactional losses originating from outdated menu pricing or unavailable food items displayed on the platform.

2 (B). Intermediary Status and IT Act Compliance: Under Section 79 of the Information Technology Act, 2000 (India), Motherhands operates strictly as an "Intermediary." We do not pre-screen, monitor, or control the menu items, descriptions, images, or pricing uploaded by the Merchants. The Merchant retains absolute sole liability for any unlawful, defamatory, or restricted content displayed on their digital menus.

C. Food Safety, Hygiene, and Legal Liabilities

The Merchant strictly guarantees that all food, beverages, and consumable items prepared, served, or delivered via the Motherhands system are processed under extreme hygienic environments in total accordance with local food safety laws. Motherhands operates strictly as a technology SaaS provider. Under no circumstances shall Motherhands be held responsible for food quality, contamination, wrong portioning, foreign objects in food, severe allergic reactions, food poisoning, or health hazards reported by End Users.

D. Subscription Plans, Billing, and Suspension

Merchants agree to pay the specific subscription, integration, setup, or transactional commission fees dictated by their selected SaaS tier. All recurring billing is automated based on the selected interval. Motherhands reserves the absolute right to suspend or permanently deactivate a Merchant's dashboard and access to the digital QR ordering menu without prior formal notice if a subscription payment is declined, delayed, or found fraudulent.

4. Financial Transactions, Cancellations, and Refunds

All digital payments are processed through heavily encrypted, secure third-party payment gateways integrated within our infrastructure. Motherhands does not store raw credit card details or net-banking credentials. Once an order has been electronically accepted by the Merchant's kitchen staff, the order cannot be canceled, and no cash or digital refund will be entertained. In the event of a technical network failure where money is debited from a user's account but the order fails to register on the restaurant's dashboard, an automated refund will be initiated back to the original source instrument within standard commercial banking timelines (usually 5-7 business days). Any exceptional refund requested due to flawed restaurant service is at the sole executive discretion of the independent Merchant.

5. Service Modification, Availability, and Discontinuation

Motherhands provides its SaaS platform strictly on an "As Is" and "As Available" foundation. We do not extend any warranty that the digital ordering service will be 100% continuous, error-free, or fully compatible with every mobile operating system or web browser.

6. Data Backup and Merchant Responsibility

While Motherhands employs highly secure cloud database infrastructure (such as Google Firebase) to maintain operational logs, daily orders, and account data, we do not guarantee absolute data permanence.

7. Intellectual Property Rights

All software architectures, source codes, visual UI designs, algorithms, database logic, branding logos, and proprietary marketing trademarks associated with Motherhands belong exclusively to us. Merchants and End Users are strictly prohibited from copying, reverse-engineering, scraping, or utilizing our software framework to build a competing digital platform.

8. Modifications of Policy and Rules

Motherhands reserves the absolute executive right to modify, add, adjust, or delete any clause, price plan, or operational rule within these Terms and Conditions at any given point without individual prior notice. Revised terms and pricing rules will instantly become active the moment they are updated on this public URL. Continued utilization of the dashboard or QR services post-update implies automatic binding acceptance of the newly established operational rules.

9. Legal Jurisdiction

These terms shall be governed by and constructed strictly in accordance with the local laws of India, and any legal disputes shall fall exclusively under the jurisdiction of the local courts where Motherhands is officially registered.
